Petkatalog Membership and Terms of Use Agreement

1. Parties

This Petkatalog Membership and Terms of Use Agreement is concluded electronically between

the party hereinafter referred to as “Petkatalog” or the “Company” and the natural or legal person who creates a membership account through the www.petkatalog.com website or Petkatalog mobile applications, hereinafter referred to as the “Member”.

Petkatalog and the Member shall each be referred to as a “Party” and collectively as the “Parties”.

2. Definitions

Platform: Means the www.petkatalog.com website and the iOS, Android and other digital applications offered under the Petkatalog brand.

Account: Means the user account created by the Member to access the Platform's services.

Services: Means product browsing and purchasing, order tracking, saving delivery addresses, favourites, coupons, promotions, points and loyalty programmes, Flash Deals, member benefits, pet profiles, product reviews, notifications and other Platform functions offered by Petkatalog.

Order: Means an electronic transaction carried out by the Member to purchase products through the Platform.

Promotion: Means coupons, discounts, points, products priced at 1 TL, Flash Deals, membership benefits, pet profile benefits, product review rewards or other promotions announced by Petkatalog.

3. Subject of the Agreement

This Agreement governs the use of the Petkatalog Platform, the creation of a membership account and the rights and obligations arising from membership.

Acceptance of this Agreement does not, in itself, constitute the purchase of any product.

Consumer sales made through the Platform are subject to the Pre-Contractual Information Form presented to the consumer during the relevant order and the order-specific Distance Sales Agreement.

The membership relationship and the product sales relationship are considered separately.

4. Membership

A person creating an individual membership must have legal capacity to act. A person creating a business account acknowledges that they are authorised to act on behalf of the relevant business or legal entity.

The Member acknowledges that the first name, surname, telephone number, email address, address and other information provided during registration are accurate, current and their own.

Petkatalog may use telephone number verification, one-time SMS verification codes or similar security methods to protect accounts.

5. Account Security

The Member must not share account access credentials, passwords or verification codes with third parties.

The Member must notify Petkatalog without delay if they notice unauthorised use, a security breach or a suspicious transaction on their account.

If account takeover, fraud, promotion abuse, suspicious payments, unauthorised access or a security threat is detected, Petkatalog may temporarily protect the account, restrict certain transactions or request additional verification.

These measures do not remove the consumer's statutory rights.

6. Platform Services

The Member may use the following services to the extent that they are offered on the Platform:

• Browse products and place orders,
• View order history and order status,
• Save delivery and billing addresses,
• Create lists of favourite products,
• Submit product reviews,
• Create pet profiles,
• Use coupons, points and promotional benefits,
• Use other membership features offered by Petkatalog.

Petkatalog may modify Platform features for technical, operational, commercial or legal reasons. Such changes do not remove consumer rights that have already arisen.

7. Delivery Services

Depending on the delivery address and order conditions, Petkatalog may offer one or more of the following methods: its own courier network, third-party carriers or shipping companies, or collection from a store.

Delivery options may vary depending on the following factors:

• Delivery address,
• The warehouse or store where the product is located,
• Stock availability,
• Working hours,
• Order amount,
• Operational capacity,
• Regional delivery conditions.

The delivery method, delivery charge and estimated delivery time applicable to the order are shown to the user before order confirmation.

8. Promotions, Coupons and Points

Petkatalog may periodically offer coupons, points, discounts, Flash Deals, products priced at 1 TL, pet profile benefits, product review rewards and similar promotions.

Where necessary, the following conditions are specified separately for each promotion:

• Validity period,
• Eligible products or categories,
• Usage limit per user,
• Minimum or maximum order amount,
• Stock limit,
• Delivery area,
• Other specific promotion conditions.

Unless expressly stated otherwise, promotional benefits cannot be converted into cash or transferred to another user.

Where objective evidence establishes the use of bots, automation, fake accounts, multiple accounts, misleading reviews, misuse of payment instruments or manipulative transactions clearly contrary to the purpose of a promotion, Petkatalog may investigate the relevant transaction and cancel any improperly obtained promotional benefit that has not yet been used.

The consumer's duly acquired rights are reserved.

9. User Content and Reviews

The Member must share only comments, reviews, images and other content that are lawful, based on their actual experience and do not infringe third-party rights.

Content containing insults, threats, personal data violations, spam, misleading information, advertising, intellectual property infringements or attempts to manipulate the review system may be withheld from publication or removed.

The Member retains the rights to the content they create. By uploading content to the Platform, the Member grants Petkatalog a non-exclusive, royalty-free licence to host, display and technically reproduce that content on the Platform and to provide the relevant service.

10. Prohibited Uses

The Platform must not be used to:

• Carry out unlawful activities,
• Access other users' accounts without authorisation,
• Circumvent or weaken Platform security,
• Generate automated traffic at a volume that disrupts the service,
• Manipulate pricing or promotion systems,
• Create fake orders or reviews,
• Infringe third-party rights.

11. Intellectual Property

The Petkatalog brand and logo, the Platform's original design, software, texts, database structure, images and other intellectual and industrial property rights belonging to Petkatalog are protected under the applicable legislation.

Rights in third-party trademarks, product images and other content belong to their respective rights holders.

12. Personal Data

Petkatalog processes personal data in accordance with the Personal Data Protection Law No. 6698 and the applicable legislation.

Details of personal data processing are explained in the Petkatalog KVKK Privacy Notice and Privacy Policy.

Acceptance of this Membership and Terms of Use Agreement does not automatically constitute consent to receive commercial electronic messages for marketing purposes.

13. Commercial Electronic Messages

Service notifications concerning order creation, payment, invoicing, delivery, account security, verification and similar matters are separate from marketing messages.

Consent for SMS, email, mobile notifications or other marketing channels is obtained separately from the user where required.

Withholding marketing consent does not prevent membership or access to ordinary shopping services.

14. Account Termination

The Member may request closure of their account through the account deletion feature provided on the Platform or through Petkatalog customer services.

Account closure does not require the deletion, before the end of the mandatory retention period, of order, invoice, payment, agreement, security and legal transaction records that must be retained by law.

Petkatalog may temporarily suspend or terminate membership in cases of fraud, serious security breaches, unlawful use or a material breach of this Agreement.

15. Platform Operation and Liability

Petkatalog implements technical and organisational measures appropriate to the risks to ensure the Platform's security and availability.

Temporary service interruptions may occur due to scheduled maintenance, internet or telecommunications outages, third-party infrastructure problems, cyber incidents or circumstances beyond Petkatalog's reasonable control.

No provision may be interpreted in a way that removes the consumer's rights under mandatory legislation.

16. Force Majeure

Natural disasters, war, widespread epidemics, decisions of public authorities, general transport disruptions, extensive energy or communications outages and similar events beyond the reasonable control of the parties may be considered force majeure.

The consumer's rights under mandatory legislation are reserved.

17. Amendments to the Agreement

Petkatalog may update this Agreement due to changes in legislation, services or the operation of the Platform.

Changes that materially affect the Member's rights are announced by appropriate means. A new version of the agreement does not apply retroactively to previously completed orders.

18. Electronic Records

Membership acceptance, agreement version, date and time, technical transaction records and relevant user actions may be stored electronically for the period prescribed by the applicable legislation.

19. Governing Law and Disputes

This Agreement is governed by the laws of the Republic of Türkiye.

In disputes where the Member acts as a consumer, applications may be made to the competent Consumer Arbitration Committees within the applicable monetary thresholds.

For disputes that must be heard by consumer courts, the applicable provisions on mandatory pre-litigation mediation remain reserved.

The consumer's statutory rights concerning territorial jurisdiction are preserved. General rules on subject-matter and territorial jurisdiction apply to commercial relationships that do not constitute consumer transactions.

20. Entry into Force

This Agreement is concluded electronically when the Member voluntarily selects “I have read and accept the Membership and Terms of Use Agreement” and completes registration.

Consent to commercial electronic messages is kept separate from this acceptance.
