Hereinafter referred to as the “BUYER”.

The mandatory provisions of consumer legislation apply to transactions in which the BUYER acts for purposes outside their trade or profession.

3. Subject of the Agreement

This Agreement governs the sale, payment and delivery of products ordered electronically by the BUYER through www.petkatalog.com or the Petkatalog mobile application, the right of withdrawal, return procedures and the other rights and obligations of the parties.

This Agreement is subject to the Consumer Protection Law No. 6502, the Regulation on Distance Contracts and other applicable legislation.

4. Pre-Contractual Information

The Pre-Contractual Information Form provided electronically to the BUYER before order confirmation forms an integral part of this Agreement.

The BUYER becomes obliged to pay the order price upon completing the electronic transaction that expressly states that order confirmation entails an obligation to pay.

Fulfilment of the order may be suspended if payment is declined or invalidated by the relevant bank or payment service provider.

The order is fulfilled through Petkatalog's courier network, a third-party carrier/shipping company or collection from a store, according to the selected method.

The applicable consumer legislation governs loss or damage during transport until the product is delivered to the BUYER or the third party designated by the BUYER.

8. Unsuccessful Delivery

If the BUYER or recipient is absent from the delivery address, cannot be contacted, or the BUYER has provided incorrect or incomplete delivery information, redelivery, collection from a carrier branch or store, or return procedures may apply depending on the nature of the order.

This does not remove the SELLER's obligations under the applicable legislation.

9. Impossibility of Performance

If fulfilment of the order genuinely becomes legally or factually impossible, the SELLER informs the BUYER as prescribed by law and refunds any amounts collected within the statutory period.

A product merely being out of stock does not, in itself, constitute impossibility of performance in the legal sense.

10. Right of Withdrawal

Where the BUYER is a consumer, except for the statutory exceptions, the BUYER has the right to withdraw within 15 days of delivery of the goods to the BUYER or a designated third party, without giving any reason or paying a contractual penalty.

The BUYER may also exercise the right of withdrawal before the product is delivered.

11. Notice of Withdrawal

Notice of withdrawal may be submitted through the following channels:

Other appropriate durable-medium methods provided on the Platform.

After giving notice of withdrawal, the BUYER sends the product back within the period prescribed by the applicable legislation.

The current provisions of distance contracts legislation apply to return transport costs.

13. Refunds

If the right of withdrawal is duly exercised, the SELLER makes the refund due to the consumer within the statutory period and without imposing additional costs on the consumer.

Where possible, refunds are made to the payment instrument used for the purchase.

The time taken by the bank or payment institution to credit the refund to the BUYER's account may be outside Petkatalog's control.

14. Exceptions to the Right of Withdrawal

The right of withdrawal is unavailable only where the conditions of a statutory exception are met in the particular case.

The following products may fall within an exception where its conditions are met:

Goods prepared to the consumer's specifications or personal needs,
Goods liable to deteriorate rapidly,
Goods whose expiry date may pass quickly,
Goods whose protective packaging, tape, seal or wrapping has been opened after delivery and which are unsuitable for return for health or hygiene reasons,
Other products and services excluded from the right of withdrawal by law.

The mere opening of a pet product or pet food package does not automatically remove the right of withdrawal for all pet products.

15. Rights Relating to Defective Goods

The right of withdrawal and consumer rights relating to defective goods are independent of one another.

The BUYER's choice of remedies for defective goods under Law No. 6502 and the applicable legislation is reserved.

A product being subject to an exception to the right of withdrawal does not remove the BUYER's statutory rights if the product is defective.

16. Promotions, Coupons and Points

The conditions of coupons, points and promotional benefits used for the order are shown to the BUYER before the order is completed.

If an order is cancelled or returned in full or in part, promotional benefits may be recalculated in accordance with the relevant promotion conditions and consumer legislation.

This calculation must not result in a restriction of the consumer's statutory rights.

17. Invoice

The invoice is issued in accordance with the applicable legislation and delivered or made accessible to the BUYER in physical or electronic form.

18. Personal Data

Personal data relating to the order are processed under the Petkatalog KVKK Privacy Notice and Privacy Policy.

Personal data necessary for delivery may be shared with the relevant transport, shipping or logistics service provider only to the extent necessary to perform the service.

19. Electronic Agreement and Retention

The following records may be stored electronically:

Pre-Contractual Information Form,
Distance Sales Agreement,
Order summary,
Date and time of acceptance,
Document version,
Document content hash,
Relevant electronic transaction records.

Users may access the agreement records relating to their own orders through their membership accounts. For guest orders, documents are delivered or made accessible to the consumer on a durable medium.

20. Dispute Resolution

In consumer disputes, applications may be made to the competent Consumer Arbitration Committees within the applicable monetary thresholds.

The applicable provisions on mandatory pre-litigation mediation apply to disputes that must be heard by consumer courts.

The consumer's statutory jurisdictional rights, including those relating to their place of residence or the place where the consumer transaction took place, are reserved.

21. Entry into Force

This Agreement is concluded when the BUYER completes the order by electronically confirming access to the Pre-Contractual Information Form, the ability to read this Distance Sales Agreement, the products ordered, the total price, delivery charges, the delivery method and the fact that order confirmation entails an obligation to pay.
